Procedure for licensing of unrenewed / expired license firearms.

STEP 1 :
FED/ROPD/PPO/CPO/CPS/MPS firearms control desk issues/recieves renewal forms to/from applicant.

STEP 2:
Applicant submits accomplished application form. FED/ROPD/PPO/CPO issues OP and MPS issue provisional receipt.

STEP 3 :
Upon payment of FAs renewal fee, FED/ROPD/PPO/CPO/MPS issues 4th copy that will serve as TL (stub from renewal form with SBR/OP

STEP 4 :
PPO/CPO submits applications to ROPD.

STEP 5 :
ROPD endorses application form to FED/CSG Satellite Offices for processing, approval and issuance of FA's license cards.

STEP 6 :
FED/FED Satellite Offices forwards approved license cards to respective ROPD for subsequent distributions to PPO/CPO/CPS/MPS for further distribution to licensee.

Q&A

 What is Executive Order 817

It is the law granting amnesty to persons with unrenewed licensed firearms and those in possession of loose/unregistered firearms; provided that the concerned individuals or holders of the firearms submit same to the Philippine National Police for registration and licensing. This amnesty program aims to account for all the unrenewed and loose/unregistered firearms.

 What is the effectivity and duration?

Applicants may register a loose firearm wtithin one (1) month upon the issuance of the IRR of EO 817 which is on October 1-31, 2009. However, proccesing for unregistered and unrenewed firearms will start on August 1, 2009.

 Who are qualified under EO 817?

Filipino citizenz who are at least 21 years of age.

 What kind/type of FAs may be registered or possessed?

The following firearms may be registered subject to the approval of C,PNP as mandated by law:

1. Handguns (Pistols/Rev) cal .22 to .357 Magnum up to .45 caliber
2. Shotguns (all gauges)
3. Rifle caliber .22
4. all other low-powered firearms
5. High-Powered Rifles not exceeding caliber 7.62 (except crew-served weapon, anti- tank, etc.)

 How many firearms can an individual register?

A qualified applicant may register any number of FA’s
Low and High-Powered FA’s -P1,000

Are government property FAs in the possession of private individuals included in the amnesty? No.

 Discounts?

The fifty percent (50%) discount usually given to gov’t officials and employees applying for Special Permits (SPs) for privately owned firearms shall not be applied under the firearms amnesty program. However, the privilege will be given upon renewal of the said license to possess firearm.

 Can a juridical entity license a “paltik” firearm in its name?

No, juridical entities are not allowed to license “paltik” firearms in their names in accordance with RA 5487.

 Can a juridical entity license a high powered rifle in its name?

No. High powered firearms applications for juridical entities have to go through the normal licensing procedure.

 Who are the authorized signatories for the Provisional or Temporary License/Permit to Transport?

C, FED/all ROPDs (R3s)/PDs/CDs/COPs

 Does the Permit to Transport cover the route of the applicant from residence to office and back?

Yes, but for one way trip only.

 Can one PTT be valid for more than one firearm?

No, one PTT per firearm only.

 What therefore is the duration of the Permit to Transport FA?

The duration of the Permit to Transport FA may vary depending on the accessibility of the offices involved in the process of registration (i.e. Land Bank, Ballistics Testing Center, etc.) but shall not be more than seven days. Valid for back and forth of the source of a FA scheduled for ballistics/stencil.

 Can the applicant bring home his/her FA after applying for amnesty even if he/she has not yet completed the process?

Yes, the applicant can bring home his/her FA even if the ballistics test is not yet finished and may return for the scheduled testing. Provided, however, that the applicant secures the necessary PTTs.

 Who may conduct Ballistic Test?

Only PNP Crime Lab in coordination with FED, CSG and PROs will conduct the ballistic test.

 Can the applicant accompany his/her FA during ballistics test?

Yes, the applicant may accompany his/her FA.

 Who will provide for the ammunitions to be used during the ballistics test of the firearm?

The Crime Laboratory will provide the ammunitions for the ballistic.

 What are the additional documents and why are they required if one is already qualified?

(UNREGISTERED FAs)

Proof of real identity
 Any of the following: Birth certificate, marriage certificate, passport, drivers license, employment ID.
 Barangay Clearance
 Local Police Clearance

Proof of billing (Meralco, PLDT, MWSS, etc.)/ Brgy Certification - place of residence.

Ballistics Test and Stencil Tracing result of FA

 Can a Filipino citizen who is below 21 years old but a gun club member be allowed to register a loose firearm under his/her name?

No, the IRR of EO 817 is very explicit in its provision that only Filipino citizens who are at least 21 years old are qualified.

 What happens if the serial number of firearm submitted for licensing already exists in the FED’s FIMS or database?

If the firearm submitted for licensing is not the same firearm with data existing in the FED’s FIMS, a serial number will be assigned
to the submitted firearm by the FED, CSG.

 If the vintage or antique firearm is not serviceable, can it be licensed under the amnesty program?

No.
